1. Introductory provisions

Basic information and definition of terms.

The operator of the website www.luxi.sk, as the administrator of personal data, hereby informs about the method and scope of personal data processing, including the scope of the customer's rights related to the processing of personal data.

When processing personal data, the operator proceeds in accordance with the following legal regulations:

• Law no. 18/2018 Coll. on the protection of personal data and the amendment of certain laws;
• Regulation (EU) 2016/679 of the European Parliament and of the Council.

The purpose is to order services for the end customer. By submitting an order, personal data is processed:

• to the extent that they were provided in connection with the order for the operator's services, or within the framework of negotiations on concluding an order with the operator, as well as in connection with the concluded order;
• for the purpose/s listed below in Article 2.

2. Purposes and periods of processing personal data

The operator processes personal data for the following purposes:

• fulfillment of an order or other obligation and provision of services;
• personal data will be processed for the duration of negotiations on the conclusion of the order between the operator and the customer, for the purpose of concluding the order, as well as during the duration of the order (maximum 5 years);
• marketing purposes - personal data will be kept for a maximum of 5 years after the order is sent, as long as the customer agrees to this before sending the order.

3. Personal data protection and processing

• If the customer does not provide his personal data, it is not possible to send the order to the operator and subsequently provide the services resulting from it. In this context, personal data are necessary for the provision of a specific service of the operator.
• After the expiration of the periods specified in Article 2, the operator deletes or anonymizes personal data. It deletes personal data for marketing purposes or sends an e-mail for the reprocessing of personal data to the customer who has agreed to the marketing purposes. In the sent e-mail, the customer will have the option to agree or disagree with the reprocessing of personal data for the operator's marketing purposes.
• The customer is obliged to provide only true and accurate personal data to the operator. The customer is responsible for the correctness, accuracy and truthfulness of the personal data provided. The operator does not assume responsibility for the correctness of the data provided.
• The operator will make every effort to prevent unauthorized processing of personal data.

The operator is authorized to transfer the customer's personal data to the intermediary for the following purposes:

• completion of the order process;
• customer support services;
• processing complaints;
• sending marketing notifications.

Personal data are and will be processed in electronic form by an automated system when the customer places an order via the website www.luxi.sk. The controller or intermediary will then work with them for the purposes stated above.

4. Rights of the customer

The rights of the customer in connection with the protection of personal data:

• request access to personal data from the controller;
• correction of provided personal data;
• deletion of provided personal data;
• limitation of personal data processing;
• file a complaint with the Office for Personal Data Protection of the Slovak Republic;
• transfer of personal data to another administrator;
• object to the processing of personal data, including profiling;
• withdrawal of consent to the processing of personal data.

You can exercise your rights regarding personal data through our contact details for the dispatching department on the website www.luxi.sk. All information and actions will be provided to you without undue delay.

If the customer exercises the right under Article 4, the operator is obliged to respond within 30 days of receiving the request.

5. Final provisions

• By sending a transport order from the website www.luxi.sk, the customer agrees that he has familiarized himself with the protection of personal data and accepts it in its entirety.
• All legal relationships arising from the processing of personal data are governed by the laws of the Slovak Republic, regardless of where the access was made. Slovak authorities are competent to resolve any disputes.
• The operator is entitled to change these terms and conditions. The new version will be published on www.luxi.sk and will also send this new version to previous customers to their e-mail addresses; the e-mail will include the option to agree or disagree with the new terms and conditions.
• The operator does not knowingly collect personal data from persons under the age of 16. If such data is discovered, it will be deleted immediately unless consent has been given by a legal guardian.
• Processing of personal data includes the collection, retention, sorting, use, storage and deletion, automatically or manually, in order to fulfil the purposes set out in Article 2.
