1. Introductory Provisions

Basic information and definition of terms.

The operator of the website www.luxi.sk as the data controller hereby informs about the manner and extent of processing personal data, including the scope of the rights of the customer related to the processing of personal data.

The operator processes personal data in compliance with the following legal regulations:

• Act No. 18/2018 Z. z. on Personal Data Protection and amending certain laws;
• Regulation (EU) 2016/679 of the European Parliament and of the Council.

The purpose is to order services for the end customer. By sending the order, personal data is processed:

• to the extent they were provided in connection with the order of services from the operator, or as part of the negotiations for closing the order with the operator, as well as in connection with the concluded order;
• for the purpose stated/purposes stated below in Article 2.

2. Purposes and periods of personal data processing

The operator processes personal data for the following purposes:

• fulfillment of the order, or other obligation and provision of services;
• personal data will be processed during the negotiations for closing the order between the operator and the client, for the purpose of concluding the order, as well as throughout the duration of the order (maximum of 5 years);
• marketing purposes – personal data will be retained for a maximum of 5 years from the submission of the order, provided the client agrees to this before submitting the order.

3. Protection of Personal Data and Processing

• If the customer does not provide their personal data, it is not possible to send the order to the operator and subsequently provide the resulting services. Personal data is essential for providing the specific service of the operator.
• After the deadlines stated in Article 2 have passed, the operator will delete or anonymize the personal data. Personal data for marketing purposes will be deleted or an email will be sent for the reprocessing of personal data to the customer who agreed to marketing purposes. In the sent email, the customer will have the option to agree or disagree with the reprocessing of personal data for the operator's marketing purposes.
• The customer is obliged to provide the operator only truthful and accurate personal data. The customer is responsible for the correctness, accuracy, and truthfulness of the provided personal data. The operator does not take responsibility for the correctness of the provided data.
• The operator will make every effort to prevent unauthorized processing of personal data.

The operator is entitled to pass the customer’s personal data to a processor for the following purposes:

• completion of the ordering process;
• customer support services;
• handling complaints;
• sending marketing notifications.

Personal data will be processed electronically by an automated system, provided that the customer creates an order through the website www.luxi.sk. Subsequently, the operator or processor will work with them for the purposes stated above.

4. Rights of the client

The rights of the customer regarding personal data protection:

• demand access to personal data from the operator;
• correct the provided personal data;
• delete the provided personal data;
• limit the processing of personal data;
• file a complaint with the Office for Personal Data Protection of the Slovak Republic;
• transfer personal data to another controller;
• object to the processing of personal data including profiling;
• withdraw consent to the processing of personal data.

You can assert your rights regarding personal data through our contact details provided on the website www.luxi.sk. All information and actions will be provided to you without undue delay.

If the customer exercises the right under Article 4, the operator is obliged to respond within 30 days of receiving the request.

5. Final provisions

• By sending a transport order from the website www.luxi.sk, the customer agrees that they have been informed about personal data protection and accepts it in full.
• All legal relationships arising from the processing of personal data are governed by the legal order of the Slovak Republic, regardless of where the access was realized. Slovak authorities are competent to resolve any disputes.
• The operator is entitled to change these terms. A new version will be published on www.luxi.sk and the operator will also send this new version to past customers at their email addresses; the email will include the option to agree or disagree with the new terms.
• The operator does not knowingly collect personal data of individuals under the age of 16. If such data is discovered, it will be promptly deleted unless consent from a legal representative has been granted.
• The processing of personal data includes collecting, storing, sorting, using, saving, and deleting automatically or manually for the purposes stated in Article 2.
